Canada exports 50Mt of coal per year which, when used, produces 150Mt of CO2. If we replaced that coal with LNG, it would reduce global emissions by 75Mt - more than 10% of Canada's total emissions. If we exported as much LNG as possible, it would reduce global emission by many times Canada's total emissions.

(3) A declaration made under subsection (1) shall cease to have effect five years after it comes into force or on such earlier date as may be specified in the declaration.
This case has absolutely no merit whatsoever. The Charter and s.33 is very clear on this matter. So they are either profoundly ignorant, or this has nothing to do with legitimately trying to change or modify the application or circumstances of the application, of s.33.
I rather think that this is an effort to limit provinces abilities to subvert Ottawa's edicts. IE. Alberta or when Ford considered using s.33 as well in Ontario.
The catch will be that not only is the law very clear, but any modification to it can not come from a court, rather it must be done via the Amendment Formula if the idea is to curtail it's usage being it is outlined clearly in clause 1.
100% agree that there is no merit based on what's written in the charter, but remember that the SCC overrode the "no barriers to trade" provision of the constitution in recent years - that provision could not have been written any clearer but the SCC essentially maintained that barriers were acceptable because provinces had traditionally maintained barriers. It has shown a willingness to ignore what's plainly written.
The open secret is that the federal government still has the power to disallow legislation under the constitution, notwithstanding use of the notwithstanding clause. Why it hasn't exercised this power on Quebec's repeated multi-decade use of the clause for purposes that undermine fundamental rights for anglophones and religious minorities would be a "problem" if they used it on Ontario or Alberta legislation. (Recall that Quebec is now one of the only jurisdictions in the Western world with unwarranted search and seizure, not to find terrorists, murderers or rapists, but employees sending emails in English.) So they're trying to get the SCC to do it for them and give them an out instead of taking a principled stand.
